PARTIES AND SERVICES
In these general terms and conditions, “you” refers to either you as an individual or your company. Nibbler Solutions is called “Treks”. The services that Treks provides are called the “service”. These general terms and conditions, together with the creation of a user account on the website Treks.se or through Treks' mobile application, are hereinafter referred to as the “agreement”. By creating a user account and using the service, you agree to the agreement at every opportunity.
You must enter your real name, company name, email address and other information that is requested when an account is registered. You confirm that you are at least 18 years old and have the right to represent your company. A user account may only be used by one person and may not be shared between several people. You may also not transfer the service to another. However, it is possible to create separate accounts for so many people who wish to use the service. You are responsible for ensuring that passwords are stored securely. You are responsible for any unauthorized use of your account. It is not permitted to use the service in ways that could damage, disable, overload or impair the service. Treks has the right to suspend you at any time if we believe you are misbehaving. If the violation is deemed to be against the law, a police report can be made. Through the agreement, you get a non-exclusive right to use the service only in your own business. The agreement does not mean that copyright or other intellectual property rights are transferred to you. You may not, in addition to what has been agreed in writing by Treks, use, copy or modify the Service.
As a user, you can cancel the service at any time. For paying subscribers of the service, termination of the agreement will apply from the end of the current payment period, usually one month. The fee for the outstanding period is thus not refunded. You cancel the service by sending an email from the login address to support [snabel-a] Treks [dot] see with “Close account” in the subject line. Treks has the right to terminate all agreements with one (1) month’s notice. Treks also has the right to terminate all agreements with immediate effect if you become insolvent; put in bankrupcy; cancels payments to Treks; has been suspended from the service; or violates any of these terms. Upon termination, Treks has the right to completely or partially delete the information you have stored in the service.
CHANGES IN THE SERVICE
The service is constantly evolving, which above all means that Treks adds new functions and improves the product. But it also means that functions sometimes change character or disappear, temporarily or permanently. Treks may, without prior notice to you, make changes to the Service or the manner in which the Service is provided. Treks may also change the service for security reasons. Treks may cease providing the service subject to the termination clause above.
When you create an account, Treks records your name, email and other information. The information is needed to enter into and complete this agreement, and for Treks to be able to provide the service and be able to contact you.
LIABILITY AND LIMITATION OF LIABILITY
Treks only compensates for direct damages caused to you through negligence on the part of Treks. Compensation is thus not paid for indirect damage, such as e.g. lost profits, reduced production or turnover in business and obstacles to fulfilling obligations to third parties. The liability for compensation is limited to the total fees for the service concerned during the agreement period, however, a maximum of one (1) price base amount in total. This limitation of liability does not apply in the event of intent or gross negligence. Your claim for damages must be made as soon as possible. If the claim is not made within six months after the tortious act occurred, you lose the right to assert the claim, if the claim could have been made in due time. Treks is not responsible for damage to your hardware, data or other information provided during the use of the service. Treks is not responsible for errors in third party products. Nor is Treks liable for damage caused by computer viruses or the like, delay, distortion or loss of your data or for your possible liability to third parties. Treks does not compensate for damage resulting from labor disputes, war, riots, unforeseen military calls, seizures, currency restrictions, export or import restrictions, earthquakes, lightning strikes, fires, floods, meteorite impacts, global warming, atmospheric pressure change or other damages. dominate or anticipate.
AVAILABILITY AND THE CUSTOMER’S RIGHT TO COMPENSATION
Treks undertakes to provide the service 24 hours a day, seven (7) days per week, with the exception of planned downtime. However, Treks only guarantees availability of 99% measured per calendar month. The measuring point is the Treks connection point to the network. You can request that the price of Treks' service be reduced if the availability is less than 99% measured per calendar month during the contract period or if the service does not fulfill what Treks has promised. Notification of a complaint must be made in writing and be received by Treks as soon as possible and no later than within six months from the time you discovered or should have discovered the reason for the complaint claim.
LOGO AND LIST OF CUSTOMERS
If you pay for and use the service, Treks may display your company name and logo in a list of customers, on the website and in other marketing contexts. If you wish that your company is not mentioned on the website together with other companies that use the service, please let us know.
MODIFICATION OF THESE TERMS
Treks has the right to change these terms and conditions at any time, as well as the prices that Treks applies in accordance with the price list in force at any given time. The changes take effect one (1) month after you have been notified on Trek’s website, by email or in any other agreed manner.
As a customer, you are obliged to pay the current price for the services. All prices are stated excluding VAT and other additional taxes according to law. Payment shall, unless otherwise agreed, be made to Treks no later than fourteen days after the invoice date.

DISPUTES AND CHOICE OF LAW
These general conditions shall be regulated by, interpreted and fulfilled in accordance with Swedish law. Any dispute is decided in Gothenburg District Court.
